PIKEVILLE, Ky., May 22 (UP) — Mallard Williams, about 35, was held here today on a charge of murdering a. Marine on leave from Camp Lejeune, N. C.

Augustus Justice, 32, was shot to death Saturday night [May 19, 1951]. The shooting occurred at Card Gap on Lick Creek, about 18 miles from Pikeville.

At an inquest yesterday Justice’s two brothers, Bennie and Elmer, Charles Lee Sawyer, Elmo Webb, and Paul Short gave their account of the shooting.

The five men were with the Marine at midnight Saturday. They said Williams drove up in a Jeep and accused Paul Short of disturbing his home. At that time the five men said Justice recognized Williams and remarked, “Let me talk with him, I know him.”

The men then testified that Williams shot Justice with his .22 caliber rifle.

Williams claims he was not there and knows nothing about the shooting. He was arrested Sunday by state police.
